Suit: Cell-phone ban violates parents’ rights

The New York Times reports that a citywide parent association has filed a lawsuit against Mayor Michael Bloomberg, Schools Chancellor Joel I. Klein, and the city’s Department of Education with the aim of overturning the city’s ban on cell phones in schools. The group argues that the ban is so overreaching and blunt that it violates parents’ rights to keep their kids safe. They also argue that the ban compromises their due process right to liberty under both the state and federal constitutions, as it interferes with the parent-child relationship without a compelling education reason for doing so. Chancellor Klein and Mayor Bloomberg have so far denied comment on the issue. However, a spokesman for Klein says the Chancellor defends the policy… (Note: This site requires free registration.)
