Klein, and the city’s Department of Education with the aim of overturning the city’s ban on cell phones in schools. The group argues that the ban is so overreaching and blunt that it violates parents’ rights to keep their kids safe. They also argue that the ban compromises their due process right to liberty under both the state and federal constitutions, as it interferes with the parent-child relationship without a compelling education reason for doing so.
